Your privacy is important to us at Fig Facial Inc. and its affiliates and subsidiaries (“Fig Facial,” “we,” “us,” or “our”), and we are committed to safeguarding, preserving and respecting your privacy rights.  This online privacy statement (the “Policy” or “Statement”) sets out how we collect and manage personal information, whether that information is collected via our websites (“Websites”), including https://formulafig.com/, or otherwise, including through our services (together, the “Services”).  In this Policy, the terms “you”, “user” and “your” refer to a visitor or user of our Services.

Submit an Application or Create an Account.  If you submit an application to use our Websites or create an account, we will collect the information you provide.  The specific pieces of information may vary, but it will generally include your name, username, email address, and preferences.

Purchase a Product or Schedule an Appointment.  If you place an order for any of our products or schedule to receive our Services, we will collect the information you provide.  The specific pieces of information may vary, but it will generally include your name, email address, shipping address, payment information, and preferences or history. 

Promotional Offers, Quizzes, Surveys, and Requests for Information.  If you request information, take part in a promotional offer, or take a survey or quiz, we will collect the information you provide.  The specific pieces of information may vary, but it will generally include your name, email address, and preferences or history. 

Employment.  If you submit an application or become employed by us, we will collect various types of personal information, including your name, government identification numbers, employment or education history, and other information necessary to administer the employment relationship or benefits.  

Interactive Chat.  If you engage with the Websites’ ChatBot, we will record the conversation.  Please note that the ChatBot is an automated program and not a real person, and information relating to your communications may be shared with our service provider. 

Social Media. If you interact with us on social media, we may collect information that you post.  Please note that your comments and information will be visible to the public, so you should never share personal information that you would like to keep private.  

Contact Us.  If you send us an email or otherwise contact us, we will collect the information you provide, including your name, email address, and any personal information you include in your message.

At this time, our Site does not respond differently based on a user’s Do Not Track signal.

Your request will be investigated as soon as possible and you will be provided with a written response.

Where Your Personal Information is Held 

Fig Facial processes personal information on our servers in Canada and United States of America and may do so in other countries.  In some cases, we may process personal information outside your own country.  We will comply with applicable laws governing the transfer of your information.  

How Long Your Personal Information is Held

We may retain your personal information as long as is necessary in order to manage our relationship with you (or fulfill the purposes for which it was collected) or as otherwise permitted by law. The length of time we retain personal information varies and may extend beyond the end of your relationship with us.

We will delete your personal information when it is no longer necessary for the purpose for which it was collected, or upon your request, subject to exceptions as discussed in this Statement or under applicable law, contract, or regulation.

Our Services may contain links to the websites of other organizations which may be of interest to you.  Similarly, you may be directed to the websites of other organizations to perform certain functions provided on our Websites.  When we provide third-party links, we do so only as a convenience and do not endorse any products or services and are not responsible for any content of any third-party website or any links contained within.  It is important to note that this Statement only applies to Fig Facial’s Services.  Linked websites are responsible for their own privacy practices and you should check those websites for their respective privacy policies.  We are not responsible and assume no responsibility for any personal information collected, stored, or used by any third party as a result of you visiting third-party websites.  Please refer to our Terms of Use for further information in relation to links to third party websites.

Children’s Privacy 

Protecting the privacy of the very young is especially important.  Our Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13.  In the event that we learn that we have collected personal information from a child under age 13 without verification or parental consent, we will immediately delete that information.  If you believe that we might have any information from or about a child under 13, please contact us using the information provided in the “Contacting Us” section below.

Unfortunately, no data transmission over the Internet can be guaranteed as completely secure.  While we strive to protect such information, we cannot and do not guarantee, ensure or warrant the security of any information transmitted to us, as it does not exist on the Internet.  

If we are required by law to do so, we will notify you and/or the relevant supervisory authority in the event of a data breach. 

You are solely responsible for ensuring that you do not disclose your account access information to third parties. This includes but is not limited to not disclosing such information to anyone, ensuring that sufficient security software is installed and running on your computer, smartphone or tablet, that your network firewall is of sufficient quality and that your wireless connection is encrypted to a degree that will prevent third party access. We are not responsible for any failure by you to secure your own device and its access to the Internet or your use of public, unsecured networks.
